Court of Appeal Grants Dr Victor Oye's Consolidated Appeal, Sets Stage for Hearing against Bwari FCT High Court Judgment

 

COURT OF APPEAL GRANTS DR VICTOR OYE'S CONSOLIDATED APPEAL, SETS STAGE FOR HEARING AGAINST BWARI FCT HIGH COURT JUDGMENT


 

On the 6th day of June 2023, the Court of Appeal announced that it is prepared to hear the appeal filed by Dr Victor Ike Oye against the judgment delivered by the Bwari FCT High Court on 10th May, 2023. This decision follows the earlier dismissal of Dr Victor Oye's interlocutory appeal, which was widely mischaracterized in some reports. It is important to clarify that the dismissal was a result of the trial court's subsequent delivery of a final judgment, rendering the interlocutory appeal moot.

During the hearing, both parties presented their arguments before the Court of Appeal. It was then customary for the court to request Dr Victor Oye's legal team to withdraw the initial appeal and instead file a composite appeal that addresses both the interim orders and the final judgment. This procedural step aligns with routine practices and procedures in appellate courts, and it is not an uncommon occurrence. Consequently, the initial appeal was struck out upon the request by the appellant to consolidate the grounds for appeal against the judgment of Justice Madugu.

With the recent ruling by the Court of Appeal, the stage is now set for the hearing of Dr Victor Oye's consolidated appeal against the judgment of the Bwari FCT High Court. This judgment is alleged to have violated the doctrine of stare decisis, a fundamental principle in legal precedent.

In response to these developments, Victor Agunzi Esq, the National Legal Adviser of the All Progressives Grand Alliance (APGA), issued a legal statement affirming the party's commitment to pursuing justice on behalf of Dr Victor Oye.
